ASC Circular 2026-009–Clearance Validity for Ad Materials of HUHS Product
Please be advised that advertising materials of HUHS products which were given a clearance validity of only until 30 June 2026 shall be renewed to obtain another clearance with a maximum validity of six (6) months from date of application. Note the following when re-applying:
- Ad materials with time bound claims such as, but not limited to, No. 1 or leadership claims, superiority claims, or comparative claims, shall be applied with the previously approved material, copy of the License to Operate (LTO) of the HUHS establishment, and most recent available support for any time bound claims.
- Ad materials without any time bound claims, shall be applied with the previously approved material and a copy of the License to Operate (LTO) of the HUHS establishment as support. For new applications which have not been given any previous clearance, the ASC shall accept copy of the License to Operate (LTO) of the HUHS establishment in place of the CPR together with all other requirements under existing guidelines, including substantiation of claims.
In the event that FDA issues a circular advising the Industry that no extension on the 30 June 2026 deadline is being given, any application done on 30 June 2026 onwards will enforce the parameters mentioned in the said circular. In the event that no circular is issued by the FDA specific to the 30 June 2026 deadline on the non-issuance of CPR, the ASC will accept the submission of the LTO in lieu of any CPR.
